CapLog Terms of Service

Welcome to CapLog! These Terms of Service ("Terms") govern your access to and use of the CapLog mobile application and related services (collectively, the "Service"). By creating an account or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using CapLog, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 13 years old to use CapLog. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are under 18, you must have permission from a parent or guardian to use the Service.

3. Account Registration

To use certain features of CapLog, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. License to Use the Service

Subject to your compliance with these Terms, CapLog grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

5. User Content

5.1 Your Content

You retain ownership of all content you create, upload, or store in CapLog, including fishing trip logs, catch records, photos, and notes ("User Content"). By submitting User Content, you grant CapLog a worldwide, non-exclusive, royalty-free license to use, store, display, and process your User Content solely to provide and improve the Service.

5.2 Content Responsibilities

You are solely responsible for your User Content and agree not to upload or share content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights of others
  • Contains malicious code, viruses, or harmful components
  • Is false, misleading, or deceptive
  • Harasses, threatens, or harms others
  • Contains spam or unsolicited promotional material

5.3 Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, without prior notice.

6. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems or bots to access the Service
  • Impersonate any person or entity
  • Collect or harvest information about other users
  • Use the Service to distribute spam or malware
  • Circumvent any security features or access restrictions

7. Location Services

CapLog may use your device's location services to enhance your experience, such as mapping fishing locations. You can control location permissions through your device settings. Location data is handled according to our Privacy Policy.

8. Third-Party Services

CapLog integrates with the following third-party services to provide and enhance the Service:

  • Supabase: For secure data storage and authentication
  • RevenueCat: For subscription and in-app purchase management and billing processing
  • Weather APIs: To retrieve weather information for your fishing locations
  • Map Services: To display location-based maps and visualizations

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

9. Subscriptions and Payments

9.1 Subscription Plans

CapLog offers both a free tier and paid subscription plans. The free tier includes limited functionality, including restrictions on the number of catches, lures, and trips you can log. Paid subscription plans unlock additional features and remove these limits. Current plan details and pricing are available within the app.

9.2 Billing and Auto-Renewal

Paid subscriptions are billed on a recurring basis (monthly or annually, depending on the plan you select). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You authorize us (through our payment processor, RevenueCat, and the applicable app store) to charge the applicable subscription fee to your chosen payment method.

9.3 Cancellation

You may cancel your subscription at any time through your device's app store settings (Apple App Store or Google Play Store). Cancellation takes effect at the end of the current billing period. You will continue to have access to paid features until the end of your current billing period. No partial refunds are provided for unused portions of a billing period.

9.4 Refunds

All subscription purchases are processed through the Apple App Store or Google Play Store. Refund requests are handled by the respective app store in accordance with their refund policies. To request a refund, please contact Apple or Google directly through their support channels.

9.5 Price Changes

We reserve the right to change subscription pricing at any time. If we change the price of a subscription, we will notify you in advance. Price changes will take effect at the start of your next billing period following the notice. Your continued use of the paid subscription after a price change constitutes your agreement to the new price.

9.6 Free Tier Limitations

The free tier of CapLog is subject to usage limits, which may change at our discretion. If you exceed free tier limits, you will be prompted to upgrade to a paid subscription to continue adding new records. Existing records will remain accessible regardless of your subscription status.

10. Intellectual Property

The Service, including its design, features, graphics, text, and software, is owned by CapLog and protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

11. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using CapLog, you consent to our collection and use of information as described in the Privacy Policy.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CapLog does not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Any defects will be corrected
  • The Service is free of viruses or harmful components
  • Weather data, fishing insights, or recommendations will be accurate

Fishing involves inherent risks. CapLog is a logging and tracking tool only. You are solely responsible for your safety and compliance with all fishing regulations and laws in your jurisdiction.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPLOG AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of your account or data
  • Any interruption or cessation of the Service
  • Any bugs, viruses, or harmful code transmitted through the Service
  • Any errors or omissions in content or data
  • Any reliance on information, recommendations, or insights provided by the Service

IN NO EVENT SHALL CAPLOG'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO CAPLOG IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless CapLog and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity
  • Your User Content

15. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service and update the "Last Updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

17. Termination

17.1 Your Rights

You may stop using the Service and delete your account at any time through the app settings.

17.2 Our Rights

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if:

  • You violate these Terms
  • Your use of the Service creates risk or legal exposure
  • We discontinue the Service

17.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We may delete your account and User Content, though some information may persist in backups for a limited time. Sections of these Terms that by their nature should survive termination will survive.

18. Dispute Resolution

18.1 Informal Resolution

If you have any dispute with CapLog, please contact us at support@caplog.com first. We will attempt to resolve the dispute informally.

18.2 Arbitration Agreement

If we cannot resolve a dispute informally, you and CapLog agree that any dispute arising from or relating to these Terms or the Service will be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify.

The arbitration will be conducted by the American Arbitration Association (AAA) under its rules and procedures. The arbitration will take place in the United States. Each party will bear its own costs and expenses, including attorney's fees.

18.3 Class Action Waiver

YOU AND CAPLOG AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

18.4 Opt-Out

You have the right to opt out of arbitration by sending written notice to support@caplog.com within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in court subject to Section 19.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any legal action arising from these Terms or the Service must be brought in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction of those courts.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CapLog regarding the Service and supersede any prior agreements.

22. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms or delegate our obligations without restriction.

23. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future.

24. Force Majeure

CapLog will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, war, terrorism, natural disasters, labor disputes, or internet service failures.
